Paul Pelosi’s Case: The Prosecutor back pedals on Language in Charge

Paul Pelosi was arraigned Wednesday . His attorney represented him, but he wasn’t present. He entered guilty pleas to both misdemeanor charges.

But the prosecution is trying to clarify what the original charge meant. It alleged that Pelosi had been under the influence of both alcohol and a drug. This was the original charge:

On or about May 28, 2022, in the County of Napa, State of California, the crime of D.U.I. CAUSING INJURY, in violation of section 23153(a) of the Vehicle Code, a misdemeanor, was committed by PAUL PELOSI, who did unlawfully, while under the influence of an alcoholic beverage and a drug and under their combined influence, drive a vehicle and in so driving, concurrently did an act forbidden by law and neglected a duty imposed by law which proximately caused bodily injury to John Doe.

Assistant district attorney Paul Gero told Fox News it was boilerplate language that had been auto-generated by the complaint. We believe alcohol .”

Here is what seems to be the boilerplate language for section 23153. (a ) that appears to have the first phrase, which contains the “or .”

Some believe the prosecution is feigning ignorance or trying to cover up something.

But what you have is an unstated charge, which doesn’t seem to fit their case theory. As stated, the charge would require evidence of alcohol or drug. This could be problematic if the charge hasn’t already been amended.

The second offense was driving while consuming 0. 08 or higher.

Although officials have yet to release the footage from the bodycam, more details were available when we reviewed the report by the California Highway Patrol.

But according to the report, he was showing “signs of impairment” when they tested him; they “observed objective signs and symptoms of alcohol intoxication,” including “red/watery” eyes, being “unsteady on his feet,” “speech was slurred,” and he had “a strong odor of an alcohol beverage emanating from his breath.”
